The YMCA in Virginia has been slapped with a lawsuit of $20 million after their negligence that led to the loss of life of a very young child. This incident took place on the 6th of December 2021, and investigations have been going on since then. There are no criminal charges upon the organization, only the lawsuit charges that inculcate $15 million in compensatory charges and $5 million in punitive damages.
According to Daily Mail and the investigations going on, it was found that the child’s death happened while 38 other children were in the pool. With this high number of children, there was just one lifeguard available with three childcare workers on duty. This mere negligence from the YMCA’s side has cost the life of a budding talent which now can never be repaired. The incident was first noticed by two children that Wingo had drowned 8 feet deep in the pool.
It was also claimed that Auston Wingo did not know how to swim, and it was the duty of the employees to keep an eye on him. Not just this, multiple claims have been made by the lawsuit and several observations have been shared by the investigators that throw light upon this unfortunate accident.

Claims by the lawsuit and the higher authorities
Having only one lifeguard with 38 children playing in the pool is an extremely dangerous task to execute. This is clearly the reason for the life that has been lost. The lawsuit filed by Contessa Gallimore claimed that the lifeguard had a navigable view of the deep end of the pool where the victim lost his life. However, he was busy using his cell phone with so many children in the pool.

The lawsuit also claimed that “The childcare workers were not properly stationed on the pool deck so as to supervise the children in the pool”. This case is under the surveillance of the Bedford Commonwealth’s Attorney Wes Nance, who said that this incident is clearly a consequence of carelessness and oversight by the authorities present at the venue.
