McBurnie, who wasn’t part of the squad, was in the dugout to see the match. He was recovering from his foot injury. The striker was wearing a protective boot after suffering a foot injury six weeks before. He broke three metatarsal bones. McBurnie claimed he was protecting his foot while going to help Brewster, who was on the ground with Brinkley. He was trying to balance himself, and the fan thought the player assault him.
McBurnie said in the court, “Trying to find my balance. I am trying my best to stay out of his way. Literally, there is no space. There is nowhere else for me to go but to the right-hand side. My left foot is on the floor within his two legs. I was using my arms for balance–it was a kind of hopping motion. It’s hard to get your balance with so many people and obstacles in the way.”
Although the Judge found McBurnie not guilty of any kind of assault. The Judge told the verdict is based on the evidence provided. The player was cleared of the charges on 15th December 2022, and the club welcomed the decision, although the club is not happy that the player underwent trial.
