This audacious move within the legal framework not only recognized but also showed one of the loopholes in the NCAA’s transfer regulations. Xavier Lucas’ attorney gave a clear message and shared the details. But why did Lucas want to transfer?

The whole situation started when Lucas got to know about his father’s life-threatening illness, and it is claimed that the real problem started at that point. He requested to leave the program, but the Badgers refused the process, citing the two-year revenue-sharing contract that Lucas had signed. Frustrated by the process, Xavier Lucas withdrew his classes from Wisconsin.

Lucas was expected to start the following season when the news of his transfer came out. And that’s when the controversy between Xavier Lucas and Wisconsin started because the NCAA has its own protocols. On “Locked On Canes,” Attorney Darren Heitner has explained the details of the loophole. Now, Lucas can leave Wisconsin for Miami, and all thanks to this NCAA loophole.

The host shared what Lucas’ attorney said, “The simplistic way to explain it is he unenrolled from Wisconsin by way of removing his spring courses prior to the start of their spring semester, which in effect caused him to be unenrolled. At that point, there’s nothing in the NCAA rules that precludes him from applying for and being admitted to any other school, and by the way, the NCAA confirmed this.

It clearly reveals that as per the NCAA rules, Lucas was not bound to stay in the Wisconsin program, and that’s the reason he is free to move to any other program of his choice.

Furthermore, the host, Alex Donno, said, as per the Yahoo report, it is confirmed that the NCAA cannot stop you from unenrolling at one school and enrolling at another. Because of that, Lucas decided to apply to the University of Miami, which is the school of his choice, and he was admitted for the fall and will be reclassified for the spring. Such a loophole has made Lucas’ case stronger.

Lucas’ attorney, Darren Heitner, also said, “They may change the rules again after this. But the important thing is I received assurance after assurance from the NCAA at the point that we figured out this solution, and there was not going to be punitive action on Xavier.” Lucas was stuck when Badgers refused to enter his name into the transfer portal, but things are now getting clear until unless the NCAA makes any new changes that can hamper the transfer.

Despite Miami’s late recruiting drive, Lucas, a four-star talent from Pompano Beach, Florida, signed with Wisconsin in December 2023. During his freshman season, he made 11 of 12 appearances for Wisconsin, starting one and recording 18 tackles, one sack, and one interception.

Darren Heitner, Lucas’ attorney, gave a five-word bold statement on social media after the recent NCAA update in the matter. He said, “Xavier Lucas is a free man.” If the controversy didn’t stop there, Yahoo Sports writer Ross Dellenger posted on X, “Lucas signed a 2-year contract with UW—a Big Ten document contingent on House approval—granting the school his NIL rights while prohibiting other schools from those rights, sources tell @YahooSports.” Heitner also responded to Dellenger; what did he say?

Heitner said, “It’s an MOU conditioned on approval of the House settlement (which has yet to receive final approval) and Xavier attending classes no later than Spring 2025 (he unenrolled from the institution). Furthermore, he sought to enter his name into the transfer portal, but the institution improperly denied his right to do so, which is a violation of NCAA rules (I wouldn’t be surprised if the NCAA takes action for that). That notwithstanding, the institution has not paid any money to him, and so he owes no reimbursement to the institution. Wisconsin’s done enough to ruin its reputation. Move on.”
