Legal battle over NASCAR’s charter system hits new phase as 23XI and Front Row Motorsports fight on
A U.S. District Judge recently denied their request for a preliminary injunction, which would have allowed them to race as unchartered teams in the 2025 season while the case was still ongoing. This decision is a big blow to the teams, who are accusing NASCAR of anticompetitive practices tied to the 2025 charter agreement.
Even though the teams didn’t get the win they hoped for in this round, they’re not backing down. The two teams are backed up against a wall and are now moving forward with plans to challenge the ruling in the Court of Appeals.

The lawsuit itself is focused on NASCAR’s negotiation tactics and how they believe those tactics are unfairly limiting competition in the sport. If the teams succeed in their appeal, it could have a huge impact on how NASCAR runs its business moving forward. With the lawsuit being such a big situation that will continue into the next year, many NASCAR critics are coming forward to talk it and recently it was Jeff Gluck and Jordan Bianchi who summed their thoughts on the fight against the governing body.

NASCAR insiders Jeff Gluck and Jordan Bianchi of The Athletic recently discussed the ongoing lawsuit involving NASCAR, 23XI Racing, and Front Row Motorsports on The Teardown podcast. The legal battle stems from 23XI and Front Row’s struggle to secure their charters, which NASCAR had initially issued to them in early September.
The latest update in the case is that both teams lost their bid for a preliminary injunction. Jeff Gluck explained that the charter agreements NASCAR provides come with a clause that prevents teams from taking legal action against the organization once they sign them. In a twist, 23XI Racing and Front Row are now asking the judge to waive this clause, allowing them to move forward with the charters that were offered to them.
However, the judge has pushed back, telling the teams they need to show proof of actual harm rather than just speculation. As a result, NASCAR has pulled back the charter agreements for both teams, making things even more complicated.

“This is not going to end anytime soon,” Gluck noted, hinting that the drama will stretch well into the offseason. With all the legal back-and-forth, it’s clear this issue will keep NASCAR insiders busy for a while. What do you think will be the outcome of this case? Will 23XI Racing and Front Row Motorsport change how the sport handles its charter deals forever, or will NASCAR penalize the teams for picking a fight and have the teams’ charters revoked?
