Towards the end of January, right as the NASCAR season was on the verge of kicking off, they detained Richard Childress Racing driver Kyle Busch in Mexico with a firearm. The two-time Cup champion was reportedly carrying a “caliber pistol-type firearm inside .38 with magazine stocked with six useful hollow point cartridges” in an airport in Quintana Roo.
The authorities subsequently sentenced Busch to 3 1/2 years in prison along with a $1098 fine.
However, the ex-face of M&M’s paid a bond of an undisclosed amount and settled the imprisonment part of his sentence. All of this led many fans and insiders to wonder just how NASCAR will react to this.

Kyle Busch is still in safe waters with NASCAR despite stepping into hot waters in Mexico
A NASCAR spokesperson recently cleared that Busch will neither be sanctioned nor be punished for what happened in Mexico. It’s worth noting that the sport has a Member Conduct Policy, and many were wondering if Busch had violated it.

“We do have a Member Conduct policy,” the NASCAR spokesperson told Autoweek. “With the information we received, we did not feel that this warranted any disciplinary action.”
Having said that, the #8 RCR driver would be ‘open’ to questions on the media day ahead of the Daytona 500, as the NASCAR spokesperson clarified. “Kyle will be at media day,” he said.
“As long as drivers are present for media obligations and respond to the questions (even if it’s no comment), they are not in violation of the driver agreement.”
Many have wondered if Kyle Busch would serve jail time for gun in bag when in Mexico. The penal code there does allow for the commutation of a sentence in this case (obviously Busch was allowed to leave so it’d make sense if this occurred). After the reports surfaced of what happened in Mexico, Kyle Busch took to social media to post his thoughts and his clarifications on how things stand with him.
“Discovery of the handgun led to my detainment while the situation was resolved. I was not aware of Mexican law and had no intention of bringing a handgun into Mexico,” according to ESPN, Busch wrote. “When it was discovered, I fully cooperated with the authorities, accepted the penalties, and returned to North Carolina.”

“I apologize for my mistake and appreciate the respect shown by all parties as we resolved the matter. My family and I consider this issue closed.”

Naturally, Busch would be hoping to keep this matter behind him and move forward as the competitive races from Daytona. But at the same time, it’s also quite obvious that he will be asked questions next week.
As for how he handles it all, we’ll see.
