Following Bubba Wallace’s single-race ban after his retaliation against Kyle Larson in Las Vegas, many had questioned if NASCAR’s penalty handling system was fair or not. One such person was Dale Earnhardt Jr as he called out NASCAR for having inconsistencies in their penalty decisions when looking at a case-by-case basis.

While having an on-track conversation with Jeff Burton, Junior mentioned, “I’ve seen some things this year that have been inconsistent. I’ve seen some drivers retaliate. I don’t care about the speed of the track, the size of the track. Retaliation. You’re trying to change the mentality going forward for not Cup drivers. They know better.”
“We’re talking about Truck drivers, Xfinity drivers. Have these same sort of penalties. Hey, I own Noah’s car, and I was surprised that he wasn’t sat out for a race.”
What did NASCAR do with Noah Gragson?

Gragson had also been involved in something similar to Wallace, which is intentionally hooking someone in order to retaliate.
Gragson chose to retaliate against fellow Xfinity Series driver Sage Karam after he did not agree with the way he was dealing with him on track. The JR Motorsports driver then hard-hooked him which spun both of them out and nearly took out half the field with them.

Later on, Junior who is also the co-owner of JR Motorsports said, “Kind of surprised that NASCAR didn’t penalize him.” Earnhart being a former driver understood the NASCAR officials had always been inconsistent with their rulings. When comparing the Gragson case to that of Wallace the penalties should have been harsh and the same, instead, Wallace was given only a one-race ban and in Gragson’s case, he received nothing.
